TERMS AND CONDITIONS

Please ensure that you read and agree to the terms and conditions below. Payment of the security deposit constitutes the guests acceptance of the following Terms and Conditions.

HOUSE RULES

You'll be staying in someone's home, so please treat it with care and respect.

1. Strictly no schoolies or gatherings of young people under 25 years old. You must be over 25 years old to book. You are agreeing that your group is either a family or corporate group.
2. No extra guests, visitors, pets, smoking, vaping, incense, illegal substances, parties, or commercial photography/filming is permitted on this property.
3. Guests must notify Stay Torquay immediately of any damage or breakages to the property or furnishings during their stay.
4. This property offers driveway and street parking only. The owners utilise the garage which is not accessible to guests.
5. The guest must every time they depart the property, securely lock doors and windows, and switch off lighting and appliances to conserve resources and avoid damage.
6. Use of tents or caravans are strictly prohibited.
7. Use of the pool and spa is conditional on the full time attendance of a responsible adult to supervise any children present and ensure safety around water. Guests are not permitted in the pool shed. There will be pool maintenance staff discreetly attending the pool daily to ensure water filtration and spa heating at approximately 9am and 5pm (residual heat will remain).
8. Disturbance to neighbours, including excessive noise, is prohibited and may result in termination of stay and loss of bond. Noise outside must be kept to a minimum after 10pm.
9. It is up to the guest to replenish staple items eg toilet paper, soap etc once the small stock of supplies run out.
10. WiFi is provided complimentary for guest use. Guests should note that internet connection speeds vary widely according to local area availability and connection type and in many cases, data may be limited.  Whilst every endeavour will be made to ensure Wi-Fi is working as intended, we cannot guarantee an available or consistent connection due to network, data or speed issues beyond our control. Compensation will not be considered in these circumstances as WiFi is provided on a complimentary basis. Ethernet ports and cords for laptops are available in most rooms.
11. Departure - the property should be left in a similar state to its condition on arrival - neat and tidy. Please place rubbish in bins provided, clean and pack away your dishes and tidy benches. If you have selected a linen service, please strip beds and place linen in laundry. Additional cleaning fees apply if the property is not left in a presentable condition.
12. Check-out time is strictly 10am.

CANCELLATION POLICY

1. Please consider your booking carefully. Your booking is non-refundable. However, in exceptional circumstances, if you cancel your holiday accommodation booking, a refund may be payable at the owner’s discretion, for example, if the accommodation is able to be re-booked for the same period. If you wish to book with a more flexible cancellation policy, please book via platforms such as Airbnb. In most cases the same properties can be booked via Airbnb, albeit with higher fees.

PAYMENT TERMS & CONDITIONS

1. The price charged is for domestic use only and not commercial use.
2. A 50% Deposit is required to secure the booking. If your booking is less than 30 days away, the total amount of the booking will be required. A booking will not be held without a deposit. If paying the initial deposit by bank transfer, the bank transfer must be completed within 24 hours to prevent the booking being cancelled.
3. The balance of the booking must be received in full, including all cleaning, linen and extra service fees, 30 days prior to occupancy. If payment is not received, Stay Torquay has the right to cancel the booking and attempt to re let it.
4. Payments can be made by Visa Card, Mastercard, Amex and Bank Transfer.
5. A security deposit (bond) of $500-$1000 is also required to secure the booking of this property. The bond covers any additional costs incurred during during a guests stay including but not limited to:
   1. any breakages or damage to the property or furnishings;
   2. missing items or theft;
   3. pets on the property;
   4. excess cleaning requirements, eg stain on carpets;
   5. excess rubbish disposal;
   6. evidence of smoking, vaping or incense including odours;
   7. lost key replacement;
   8. extra guests staying or visitors accessing the property;
   9. parties or events held at the property;
   10. disturbance to neighbours;
   11. lost property return to the guest; or
   12. call outs for non emergency reasons.
6. If none of the above incurred costs have been found after checkout, the security deposit (bond) will be fully refunded within 14 days after the property has been cleaned and inspected. Please note that no responsibility will be taken by the owner if account details supplied by the guest are incorrect for bond refund.

OTHER

• The property is let to you for the period stated in your booking confirmation. You agree to not sublet or assign the property or any part of it.
• Guests are responsible for their choice of accommodation. Stay Torquay is not responsible if the style of property does not live up to guests expectations. Guests should view property listing details thoroughly.
• All bookings are for the dates shown on the receipt only. A booking is confirmed upon receipt of full payment 30 days prior to check in.
• Stay Torquay will make every effort to ensure the property is available as advertised. However Stay Torquay reserves the right to make alterations to the home, display photos or to bookings due to unforeseen circumstances.
• Variations to any of the above terms and conditions may only be made by prior arrangements with Stay Torquay in writing.

AGREEMENT

I/We as Guests, agrees to occupy and use the property entirely at our own risk. To the fullest extent permitted by law, the Guest indemnifies and holds harmless the Property Owner and Stay Torquay from and against any claims, losses, damages, liabilities, costs or expenses arising from:

• the Guest's use or occupation of the property;
• any injury, loss or damage suffered by the Guest or any occupant or visitor invited onto the property by the Guest, except where caused by the negligence or wilful misconduct of the Owner or Property Manager;
• any loss, damage or injury caused by the Guest or any occupant or visitor to the property or neighbouring properties;
• any noise, disturbance or inconvenience caused as a result of renovation/building/road works being carried out in or near the vicinity of the holiday accommodation; or
• the standard of any privately owned holiday accommodation furnishings and fittings.

We hereby acknowledge and agree that Stay Torquay has the absolute and sole discretion to cancel my/our occupancy in the event that my/our actions or behaviour compromise the safety and/or quiet enjoyment of neighbouring properties or others. I/We hereby agree that I/we will be fully responsible and liable for payment of all charges incurred, irrespective of such cancellation, together with any financial loss suffered by the Property Owner and/or Agent, to be debited to my security deposit and/or credit card without further notice.

• *7 night minimum December-January & Easter school holidays *5 night minimum February-April (please message us directly to request this as a 7 night minimum is the website default)
• Check in days are SATURDAYS only (or Friday's by request, subject to availability - very unlikely during Summer)
• The property is unavailable for stays between May - November
• A Deposit of 50% plus a bond of $500 is required to confirm the booking. The bond of $500 is fully refundable within 14 days of check-out and is subject to a damage inspection of the accommodation.
• The fireplace is for decorative purposes only and is strictly NOT to be used between Dec - April.
• The property includes video surveillance at the entrance door and overlooking the lockbox parking area. The security cameras in hallway, alfresco and back yard are not in operation.
• The garage, main driveway, shed, side gate and a portion of the back yard will be utilised by the owners and is fenced off and not accessible to guests.
• The pool is not heated. The spa will be heated daily for you and will require maintenance staff to attend the pool shed twice a day at approximately 10am and 5pm each day. The spa will not be heated after 5pm (residual heat will remain). If you do not wish to heat the spa during your stay please let Stay Torquay know at time of booking.
