TERMS AND CONDITIONS

You'll be staying in someone's home, so please treat it with care and respect. Please ensure that you read and agree to the terms and conditions below. Payment of the security deposit or bond constitutes the guests acceptance of these Terms and Conditions.

HOUSE RULES

1. Strictly no schoolies or gatherings of young people under 25 years old. You must be over 25 years old to book. You are agreeing that your group is either a family or corporate group.
2. No extra guests, pets, smoking, vaping, illegal substances, parties, or commercial photography/filming is permitted on this property.
3. This property is strictly non-smoking, failure to comply and if evidence is found of smoking inside the property it will result in an immediate $250 fine and will be taken out of the bond.
4. Should any form of party or event be held at the property the guest agrees that they are liable for additional charges at a rate of $200 per hour via the bond or credit card provided. Any damage to the property will also be added to this amount. An invoice and log of time will be supplied including date & time of works actioned.
5. This property offers street parking only. The owners utilise the garage and driveway and vehicles are not permitted on the property at all times.
6. Only the guests nominated and agreed in the booking may stay at the property. The number of guests should not exceed the number stated on the booking confirmation. Fees will apply for excess guests not agreed with the owners in advance. If any persons other than registered guests are invited on to the property (including visitors) then the total bond may be forfeited. The guest will also be liable to termination of the booking with no refund.
7. Use of the pool and spa is conditional on the full time attendance of a responsible adult to supervise any children present and ensure safety around water. Guests are not permitted in the pool shed. There will be pool maintenance staff attending the pool daily to ensure water filtration and spa heating from 10am - 5pm.
8. Disturbance to neighbours, including excessive noise, is prohibited and may result in termination of stay and loss of bond. Noise outside must be kept to a minimum after 10pm.
9. WiFi is provided complimentary for guest use. Guests should note that internet connection speeds vary widely according to local area availability and connection type and in many cases, data may be limited.  Whilst every endeavour will be made to ensure Wi-Fi is working as intended, we cannot guarantee an available or consistent connection due to network, data or speed issues beyond our control. Compensation will not be considered in these circumstances as WiFi is provided on a complimentary basis. Ethernet ports are available in most rooms.
10. Departure - the property should be left in a similar state to its condition on arrival. Please place rubbish in bins provided, clean and pack away your dishes and tidy benches. If you have selected a linen service, please strip beds and place linen in laundry.
11. Check-out time is strictly 10am.
12. Stay Torquay takes no responsibility for the guest's personal property left behind. Return of personal property may be returned at the guest's cost for a minimum of $50.
13. Stay Torquay will make every effort to ensure the property is available as pictured. However Stay Torquay reserves the right to make alterations to the home, display photos or to bookings due to unforeseen circumstances.

CANCELLATION

1. Cancellation is fully refundable if your check in date is more than 3 months away. Please contact Stay Torquay to process your cancellation as soon as possible.
2. A cancellation service fee of $200 is charged for any cancellation within 3 months of check in date.
3. Between 2 - 3 mths of your check in date, you will receive a refund of 50% of all moneys paid minus the $200 cancellation fee.
4. Between 28 days - 2 mths of your check in date, you will receive a refund of 25% of all moneys paid minus the $200 cancellation fee.
5. If you wish to cancel your booking and your check in date is less than 28 days, you won't receive a refund for your booking. It is too late for us to re-let the property.

PAYMENT TERMS & CONDITIONS

1. The price charged is for domestic use only and not commercial use.
2. The balance of the booking must be received in full, including all cleaning, linen and extra service fees, 28 days prior to occupancy. If the payment is not received, Stay Torquay has the right to cancel the booking and attempt to re let it.
3. A 50% Deposit is required to secure the booking if it is more than 30 days out of check in date.  If it is less that 30 days, the total amount of the booking will be required. A booking will not be held without a deposit. If paying the initial deposit by bank transfer, the bank transfer must be completed within 24 hours to prevent the booking being cancelled.
4. Payments may be made by Visa Card, Mastercard, Amex, Bank Transfer.
5. A bond of $500 is also required to secure the booking of this property. The bond covers any additional costs incurred including but not limited to, any breakage, damage or theft, excess cleaning requirements, evidence of smoking, lost keys, extra guests or visitors beyond those declared, disturbance to neighbours. The security deposit will be fully refunded within 14 days after the property has been cleaned and inspected if no damage, extra cleaning, services or theft has been found. Please note that no responsibility will be taken by the owner if account details supplied by the guest are incorrect for bond refund.
6. Damage, Breakages, Theft and Loss are the guests responsibility during their stay and funds will be taken out of the held bond for payment. Guests must notify the host of this immediately. Stay Torquay may recover from you repair or replacement cost (at Management's discretion). Any damage not reported or found on inspection for the rental will be deducted from the bond or the guest will be taken to VCAT and additional costs for attendance will be claimed.
7. Excess Rubbish Removal fees may apply if the amount of rubbish left at the property is deemed over and above what should be reasonably expected for the length of stay and number of guests.
8. Variations to any of the above conditions may only be made by prior arrangements with Stay Torquay in writing.

• Check in days are SATURDAYS only (or Friday's by request, subject to availability)
• The property is unavailable for stays between May - November
• A security Deposit of $500 is required to confirm the booking. The security deposit is refundable within 14 days of check-out and is subject to a damage inspection of the accommodation.
• The fireplace is for decorative purposes only and is strictly NOT to be used between Dec - April.
• The property includes video surveillance at the entrance door and overlooking the lockbox parking area. The security cameras in hallway, alfresco and back yard are not in operation.
• The garage, main driveway, shed, side gate and a portion of the back yard will be utilised by the owners and is fenced off and not accessible to guests.
• The pool is not heated. The spa will be heated daily for you and will require maintenance staff to attend the pool shed twice a day at approximately 10am and 5pm each day. The spa will not be heated after 5pm (residual heat will remain). If you do not wish to heat the spa during your stay please let Stay Torquay know at time of booking.
